1. Krystyna Kidson’s commitment to privacy: 

 

1.1. Krystyna Kidson – Psychologist – Coach – Supervisor (hereafter "Krystyna Kidson", “I”, “me” or “my”) is committed to safeguarding the privacy of my clients, staff and visitors of Krystyna Kidson, as well as those who visit my website. 

1.2. Krystyna Kidson is bound by the Privacy Act 1988 (Cth) (Privacy Act), the Australian Privacy Principles, and other laws governing how health service providers handle your Personal Information and Sensitive Information (including information about your health). 

1.3. This Privacy Policy (Policy) sets out how I collect and treat your Personal Information and Sensitive Information. The Policy applies to my website www.krystynakidson.com, which is operated by me, and to the products and services provided by me.

2.1. “Personal Information” is categorised as information held by Krystyna Kidson, that may identify you, or by which your identity might be reasonably determined. The information you provide me may include, amongst other things, your name, address, email address and phone number. It does not include “Sensitive Information”. 

2.2. “Sensitive Information” means any information about an individual’s racial or ethnic origin, political opinions, membership of a political organisation, religious beliefs or affiliation, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual preference or practices, criminal record or health information.

To provide my services to you, Krystyna Kidson may receive and store Personal Information and Sensitive Information (together, ‘your Data’) that you enter onto our website, provide to me directly or give to me in other forms, including my Waiver & Release Form and Participant Information Sheet.

3.2. Your Data may include your: 

3.2.1. Contact details including name, phone number, address and email address; 

3.2.2. Payment and billing information, which I may use to bill you for my services and to process your payments (including credit card details);

3.2.3. Health information (both physical and mental health) including information relating to injuries past or present, or whether you are pregnant; 

3.2.4. Personal history and family history; and 

3.2.5. Other information voluntarily provided by you. 

Your Data is collected to ensure your safety and wellbeing, and that of other participants and facilitators in my service, to send information, provide updates and process purchases of services and products provided by Krystyna Kidson. 

3.3. Sensitive Information, which includes the definition of your Data relating to your health, will not be collected unless you consent to the collection of that information. 

3.4. Krystyna Kidson collects your Data from you in a variety of ways, including but not limited to:

3.4.1. Direct interactions: Information you provide directly when you fill out forms, during consultations and conversations, through email correspondence, or via phone calls.

3.4.2. Online interactions: Information collected when you visit my website, register for services online, complete online forms, or engage in online chat or messaging services.

3.4.3. Events and workshops: Data collected when you participate in events, workshops, or training sessions, including any feedback or evaluations you provide.

3.4.4. Third-party sources: Information received from third parties with your consent, such as referrals from other professionals, or data from social media interactions, where you have engaged with my social media profiles (professional or personal; see my Social Media Use policy for further information on the latter).

3.4.5. Automated technologies: Data collected through the use of cookies and similar technologies when you interact with my website, to enhance your user experience and for analytical purposes.

3.4.6. Documentation: Information included in any written or electronic forms, such as Waiver & Release Forms, Participant Information Sheets, and any other documents relevant to the services provided.

3.5. I may collect additional personal Data at other times, including but not limited to, when you provide feedback, when you provide information about your personal or business affairs, change your contact or email preference, respond to surveys and/or promotions, provide financial or credit card information, or communicate with me in any other way. 

3.6. It is possible I may receive your Data from third parties. Those third parties may include your medical practitioners, hospitals, clinics, lawyers and/or family members. If I do, I will protect and use this information as set out in this Policy.

4. Use of Your Data 

 

4.1. Personal Information collected by me will only be used and disclosed for the purpose for which it was collected as set out below. This includes maintaining your account and contact details, providing you with my products and services, and processing payments. 

4.2. Krystyna Kidson may use Personal Information collected from you to provide you with information and updates on my services, additional products, or opportunities available to you. 

4.3. I may use your Personal Information to improve my products and services and better understand your needs. 

4.4. We may from time to time use your Personal Information for another purpose where it would be reasonably expected by you or if permitted by the Privacy Act. This includes to effect or enforce a transaction, or procure advice from legal and accounting firms, auditors and other consultants. 

4.5. Sensitive information will only be used and disclosed for purposes directly related to the provision of my services and as necessary for compliance with legal obligations. This includes, but is not limited to, the following purposes:

4.5.1. To provide tailored coaching, training, and supervision services that meet your specific needs.

4.5.2. To communicate with relevant health or legal professionals with your consent, where necessary for your care or as required by law.

4.5.3. To ensure the security and integrity of my services, including fraud prevention and data protection measures.

4.5.4. For research and analysis purposes, with all identifying information removed, unless you have explicitly consented to the use of your identifiable sensitive information.

4.6. I may contact you using various methods, including but not limited to:

4.6.1. Email: For updates, newsletters, and detailed communications.

4.6.2. Phone: For urgent matters or detailed discussions requiring direct communication.

4.6.3. Text Messages (SMS): For appointment reminders, quick updates, or confirmations.

4.6.4. Postal Mail: For formal correspondence or documentation that requires physical delivery.

4.6.5. Social Media: For announcements, general information, or if previously agreed upon as a communication method.

4.6.6. Online Platforms: Via secure messaging on our website or through other digital tools we may use for providing services.

5.2. Personal Information is only supplied to a third party when it is required for the delivery of my services. 

5.3. I may from time to time need to disclose Your Data to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request. 

5.4. I may use Your Data to protect the copyright, trademarks, legal rights, property or safety of Krystyna Kidson, www.krystynakidson.com, its clients or third parties. 

5.5. I may also use and share aggregate or non-personally identifying information about clients for market analysis, research, marketing or other purposes. 

5.6. I will not disclose, sell, share or trade your Personal Information to any third parties unless I first receive your consent, except as set out in this Policy. 

5.7. I may provide health information (Sensitive Information) to:

5.7.1. Relevant health professionals: Such as your primary care physician, specialist doctors, or allied health providers, but only with your explicit consent and where necessary for your care and treatment.

5.7.2. Legal and regulatory authorities: If required by law or regulation, I may disclose your Sensitive Information to comply with legal obligations, such as reporting to health authorities, complying with court orders, or fulfilling other legal requirements.

5.7.3. Emergency situations: In the event of an emergency where your health or safety is at risk, I may disclose your Sensitive Information to emergency responders or other appropriate personnel to ensure you receive necessary care.

5.7.4. Professional advisors: On occasions where it is necessary to seek professional advice, such as from legal counsel or auditors, and only when they are bound by confidentiality agreements to protect your privacy.

I recommend that you seek independent advice to ensure that you fully understand how your Sensitive Information is stored and shared in compliance with legal requirements and best practices.

5.8. Information that I collect may from time to time be stored, processed in or transferred between parties located in countries outside of Australia. 

5.9. If there is a change of control in my business or a sale or transfer of business assets, I reserve the right to transfer, to the extent permissible at law, my user databases together with any Personal Information, Sensitive Information and non-personal information contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. I would seek to only disclose information in good faith and where required by any of the above circumstances. 

5.10. By providing us with your Data, you consent to the terms of this privacy policy and the types of disclosure covered by this policy. Where we disclose your Personal Information to third parties, we will request that the third party follow this policy regarding handling your personal information.

6. Security of Your Data

6.1. Krystyna Kidson is committed to ensuring that your Data is secure.

6.2. Krystyna Kidson will take reasonable steps to protect your Data from misuse, loss, unauthorised access and modification or disclosure.

These steps include:

6.2.1. Physical Measures: Implementing secure access controls to office premises and secure storage for physical records.

6.2.2. Technical Measures: Using encryption for data in transit and at rest, implementing firewalls and anti-virus software, and regularly updating and patching software systems to protect against vulnerabilities.

6.2.3. Administrative Measures: Training staff on data protection best practices, conducting regular audits of data security procedures, and having clear policies and procedures for handling and responding to data breaches.

6.3. Despite taking appropriate measures to protect your Data used and collected by me, please be aware that no data security measures can guarantee 100% security all of the time. The transmission and exchange of information is carried out at your own risk.

6.4. I cannot guarantee the security of your Data that you transmit to me, or receive from me. Although I take measures to safeguard against unauthorised disclosures of your Data, I cannot assure you that your Data I collect will not be disclosed in a manner that is inconsistent with this privacy policy.

6.5. You are solely responsible for maintaining the secrecy of any passwords and other account information pertaining to my Platform, apps or services.

 

7. Access to your Information

7.1. You may request details of your Data that I hold about you in accordance with the provisions of the Privacy Act1988 (Cth). 

7.2. A small administrative fee may be payable for the provision of your Data. If you would like a copy of your Data which I hold about you or believe that any of your Data I hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please email me at admin@krystynakidson.com

7.3. We reserve the right to refuse to provide you with your Data that we hold about you, in certain circumstances set out in the Privacy Act. 

 

8. Website

8.1. When you visit the website of Krystyna Kidson www.krystynakidson.com, I may collect certain information such as browser type, operating system, website visited immediately before coming to my site, etc. 

8.2. This information is used in an aggregated manner to analyse how people use my site, such that I can improve my service. 

8.3. My website may use cookies to enhance your experience. Cookies are small files stored on your device that help remember your preferences and activity on the site. 9. Marketing Emails.

 

9.1. I may send you direct marketing emails and information about products and services that I consider may be of interest to you. These communications will be sent pursuant to restrictions including the Spam Act 2004 (Cth). 

9.2. If, at any time, you would like to stop receiving these promotional emails, you may follow the opt-out instructions contained in any such email. Please note that it may take up to 5 business days for me  to process opt-out requests. If you opt-out of receiving emails or promotions from me, I still may send you emails about your account, any services you have requested or received from me, or for other customer service purposes. I do not provide your personal information to other organisations for the purposes of direct marketing. 

9.3. If you receive communications from me that you believe have been sent to you other than in accordance with this Privacy Policy, or in breach of any law, please contact me using the details provided below. 

 

10. Coronavirus (COVID-19) or other Epidemic/Pandemic reporting requirements 

10.1. In the event that staff or facilitators of Krystyna Kidson, my clients or any visitors contract or are suspected of contracting COVID-19 or other significant epidemic/pandemic-related illnesses, we may be required to disclose names and contact details of those people to relevant government agencies such as NSW Health.
